Due to busy schedules, many start-up businesses often forget to register their trademarks. Only through a period of operation, with turnovers and a relative number of customers, will the businesses begin to “refine” its internal legal work, including the exclusive registration of trademarks.
However, this process is quite “risky”.
It is necessary to search NOIP’s database to know whether your logo is registered.
Because there will be cases in which upon registering trademark, an enterprises find out that the logo it used for a long time is accidentally similar to others, causing confusion, or even registered to own by other individuals/ enterprises.

The only action that the businesses can taken then is changing all or part of their brand identity system. The cost of “rebuilding” and marketing another brand toward customers is extremely costly.
The lawyer accompanying the brand design team will promptly check the sketches of the logo/ trademark to see whether or not it is identical/ similar to other parties’ which have been already registered.
A trademark is an asset that is not easily measured by money.
Approving a logo/ trademark with the participation of an attorney will ensure that: the trademark created by your design team shall be “unique”, therefore fully legal to be accepted by the NOIP.
You can log on to http://www.noip.gov.vn, which is the official website of the National Office of Intellectual Property (NOIP) - the entity that manages and approves applications related to intellectual property in Vietnam (including trademark registration applications). At the website, you can also find legal information and documents regulating the field of intellectual property.

On Digital Library of Industrial Property category (located at the left corner of the website), you can search for information about applications for protection of inventions, utility solutions, industrial designs, publicly announced trademarks and industrial property objects that have been granted certificates and are being protected in Viet Nam.
