1. Not registering your trademark means not having the proper ownership to your trademark

Nowadays, designing a logo is quite simple. However, a full brand identity set consisting of branding guidelines, envelopes, folders, product packages, and labels can be very costly. If you are owning a start-up business, it is not too expensive to simplify your name into an icon for easy printing on some of the most commonly used publications such as business cards and contracts.

Have your business registered a logo?

Company logo design is a must-do item of a business. However, if you are satisfied with your logo, you put it into use and inform customers that “this is my logo”. However, if you use a logo without registering, your opponent can copy yours and register it with the National Office of Intellectual Property ahead of you. And if succeed, they definitely have the right to claim that: “No, this logo is mine”. Then, you will lose your symbol in an instant, lose the ownership over your own logo.

The situation of trademark stealing is not uncommon. For example, DAK LAK coffee, BUON MA THUOT COFFEE, Phu Quoc fish sauce, premium fish sauce Phan Thiet are famous regional products of Vietnam; however, these brands are now owned by foreign companies.

Surely those who have expertise in branding know about the renowned case of Trung Nguyen reclaiming their brand. In 2000, Trung Nguyen expanded business into the US market only to find that its brand was already taken by a company named Rice Field. The Trung Nguyen brand was registered by this US company with both the USTPO (United States Patent and Trademark Office) and WIPO (World Intellectual Property Organization). To settle the case, the owner of Trung Nguyen had to spend thousands of dollars and two years to regain his brand.

3. Instructions to prepare trademark registration applications

You can search for information on your own to prepare trademark registration application for your business. Information on the website of NOIP (National Office of Intellectual Property) is clear and helpful. Go to: http:// www. noip. gov .vn.

On NOIP website, you can find the “Trademark” section in the menu bar (under Industrial Property Objects), showing all the items such as: definition, explanation, and required documents; download the application and file following the instructions. Currently trademark registration in Vietnam applies Nice Classification Table version 11-2018, an international classification of goods and services (translated from the English version published by WIPO).
